Parents in Arab society did not take any responsibility for their children in the pre-Islamic era. The husband, as the head of the family, used to treat family members as his servants and forced them in the direction of his interests. No matter the rationale behind it, the burial of daughters in the pre-Islamic era is an outrageous and ill-treated tradition. In this study, it is possible to see which tribes in the Arab society started this repellent custom and which (...) ones were more common. In the society, it is possible to find that there were conscientious and virtuous people trying to prevent these events which can be called as a shame of this humanity, which does not approach the events with the value judgments of that day. Before shedding light on the motivations behind this tradition in the Jahiliyyah Arab society, the examination of the treatment towards daughters in other parts of the World in the same era, would be meaningful in terms of enlightening the phenomenon. This study aims to crystallize the causes, extent, and responses by wise people towards the burial of daughters in the pre-Islamic and Prophetic era.Summary: The burial of daughters or their slaughter in a variety of ways was not unique to the Arabs. At that time people and animals in many parts of the world were sacrificed to give thanks to the gods and to ease their anger. When the killings of girls are considered, Arab society comes to mind. In that time, other countries and nations in the world were not different from the Arabs. During this period, daughters were killed in different ways, not through the burial of living alive.During the Jahiliyya period, among the Arabs who murdered the children of the boys, the girls, and children who were considered to be the weakest members of the family were conducted with this treatment. Men who were the head of the family could tolerate having one or a maximum of two girls. When the number of girls increased, they regarded it as a matter of honour so that when a new daughter was born, the inevitable attempt was to murder her.In the Arabian peninsula - rich merchant families exceptional - families were trying to survive with scarce opportunities. The food and clothing materials used were usually exported and extremely expensive. Therefore, there was a necessity for male members of the family who would provide for the family. From this perspective, so many sons meant dignity. The economy of the day was based on looting and pillaging except for the trade of the elite. Therefore, one had to be strong. The birth of a daughter meant shame, sadness and grief instead of joy and happiness for them. The man would wait excitedly for good news. If the baby was a boy the family rejoiced. However, if it was a daughter the father would be upset. When a person said, “She was a daughter” she could not know what to do with her shame and how to hide from people.When the Arab tribes were examined in general, the burial of daughters was not extended to the whole population. The question of murdering the girl by burying her child was common among Bedouin Arabs who lived in the desert rather than the city. It was extremely difficult to see this tradition in the tribe of Quraish, which were regarded as the masters of the Arabs. When we look at the sources of Jahiliyya and Islamic history, it is observed that the examples of this outrages customs were generally realized in the near term. It is understood that the memory of society is not rich enough to comment. The main reason for this is that Arab society has not a written culture.For the Jahiliyya Arabs, her daughters were ashamed. If they married their daughters even before they had married their daughters into adultery, seeing it as lighter than their children. One of the main reasons was jealousy. The data show that this style was applied more intensely among the Bedouin tribes and especially the tribes of Temim, which is considered to have started the process of burying girls. It is also said that the most jealous tribe of the Arabs is the Rebia tribe. Because of this feature, it is accepted that the first burial of the girl was started in this tribe.Although the Arab society before Islam was known by the atrocities of ignorance and weakness, there were people who were not completely dead and consciously dead. Even though they buried girls alive in society, some people who were disturbed by this rite that destroyed human dignity were trying to prevent ignorant and cruel fathers. The most well-known of the these was the famous poet Ferezdak, grandfather Sasaa b. Naciye.One of the main reasons for the behavior of burying girls alive before Islam was the fear of poverty. Most of them were living in the midst of starvation, and they were considering their daughters as burdens for the family. So they were burying their daughters because of poverty and hunger.One of the reasons for the murder of girls was the sense of honour. In Jahiliyya when a man marries a woman does not come to mind this sense, while marrying his own daughter to someone else sees this as a matter of dishonesty and and he says “it was more sweet to me to bury my daughter with my own hands rather than to marry my daughter. The idea of honour among the Arabs was the idea that their daughters and women would one day be in the hands of the enemy and thus would become a concern for themselves.One of the attributes of the nobles of Arabs was pride and vanity. If someone become arrogant to him and he doesn’t reply, he would be considered a coward. This arrogance dominated the movements of the people of the ignorance. In their eyes, it was so bad to marry someone who was not equal, that they were more likely to die than marrying someone. They were doing this because they had a bit of compassion for them. According to them, girls could not shoulder the heavy burden of life. There were many ways to kill the girl before Islam. But the most common of these was to push him into a hole he had dug before and to throw soil over her and bury her alive. The most commonly used method of killing girls by dumping them in the pits, though, was that they were drowned in the water or strangled. (shrink)

Tartışmalarda belirli soru ve cevap türlerine başvurulmuş, soruların tertibine özen gösterilmiştir. Bu sayede taraflar kendi görüşlerinin doğruluğunu, karşıt görüşün yanlışlığını çelişkiye düşmeden ortaya koymaya çalışmıştır. Bu çalışmada ilk olarak cedelden ve cedelin fıkha tatbikinden bahsedilmiş, sonrasında münâzaracı kimlikleriyle meşhur olan Hanefî fakihi Kudûrî ile Şâfiî fakihi Ebu’t-Tayyib et-Taberî arasında geçtiği rivayet edilen talâka dair bir münâzara inceleme konusu edilmiştir. Bu münâzarada, muhâlea ile boşanılan kadına, kadının iddeti esnasında (...) tekrardan ricî talâk yapılabileceğini savunan Kudûrî ile bu durumda talâkın geçersiz olacağını söyleyen Taberî’nin karşılıklı istidlal ve itirazları yer almaktadır. Bu tartışmanın temelini Kudûrî’nin muhâlea yapılan kadını ricî talâkla boşanan kadına kıyas etmesi oluşturmaktadır. Taberî bu kıyasın illetine yönelik mutâlebe, itirâz ve muâraza türü sorulara başvurmuş, Kudûrî ise kendi illetinin sıhhatini savunmaya çalışmıştır. Yer yer tartışma kurallarına atıfların yapılması yönüyle de önemli olan bu münâzara incelenirken, cedelin fıkha tatbikine dair kısımda zikredilen bilgilerin pratikte nasıl uygulandığına işaret edilmiştir. Bu çalışma, Afrika Boynuzu’nda yer alan Eritre devletinin bağımsızlığı konusunun uluslararası alanda gündeme geldiği iki tarih olan 1950 ve 1990’ların başlarını odağa alarak, 1950’lerde onaylanmayan bağımsızlığın 1990’larda onaylanmış olmasını sorun edinmektedir. Bu açıdan, çalışmanın ilgi alanını bağımsızlık gündemine taraf devlet ve örgütlerin faaliyetleri oluşturur. Eritre’nin bağımsızlığı meselesinin kırk yıl ara ile farklı kararlarla sonuçlanmasının, bölgede çıkarları bulunan uluslararası aktörlerin tutumları, Birleşmiş Milletler’in rolü ve kararları ve bölge ülkelerinin iç dinamikleriyle doğrudan ilintili olduğu öne sürülmektedir. Bu bağlamda, Etiyopya ve Eritre’nin tarihsel (...) birlikteliği ve ayrımına odaklanarak, bu iki coğrafyanın ilişkisinin Eritre’nin bağımsızlığı özelinde üstünde durulan bir unsur olduğu gözler önüne serilmektedir. Bu iki ülkenin bir aradalığını ön gören ve görmeyen argüman ve tarihsel gelişmeler ele alınarak, Eritre’nin ikinci bağımsızlık gündeminde, ilkinde olmayan karşılıklı uzlaşı ve Eritre’nin ulusal niteliğinin üzerinde durulmuştur. İkinci olarak, self-determinasyon ve ayrılma konusunda dünyada yaşanan gelişmelerin Eritre’nin bağımsızlığına nasıl etki ettiği analiz edilmektedir. Bu noktada uluslararası örgütler tarafından alınan kararlar ve değişen normlar incelenmektedir. Son olarak Soğuk Savaş’ın tırmanma ve sönümlenme evrelerini merkeze alarak, ülkenin geleceğinde dış aktörlerin bölgesel ve küresel politikalarının nasıl belirleyici olduğu sorgulanmıştır. Özellikle ilk bağımsızlık gündeminin Soğuk Savaş politikaları gereği desteklenemeyecek ve Etiyopya’nın toprak bütünlüğünü savunacak bir konjonktürde, ikincisinin ise blok politikalarının çözüldüğü ve küresel dönüşümün başladığı yeni bir geçiş evresine denk geldiği için dış aktörlerce olumlu karşılandığı ve mümkün hale geldiği ileri sürülmüştür. Education is a phenomenon that has existed from the early times of human beings, but it has recently become a scientific discipline. Until recently, there were no separate fields such as education, religious education, moral and value education. Therefore, their separation from each other as scientific disciplines is also a new phenomenon. In fact, in the historical process, education has a religious and moral character in itself, and these two have not seen independent from each other. Here religion has provided (...) meaningful goals and objectives to education, while morality constitutes one of the important aims of this education. Besides, the religious and moral character of education has also been significant in order to accrue a positive and balanced personality. For this reason, it is of great importance to understand how the modern concepts of education, religious education, and moral education have been dealt with in traditional education or in historical processes. Hārith al-Muhāsibī (d. 243/857), among the founding names of Ahl as-Sunnah theology and Sufism, was one of the early scholars who emphasized that the heart, mind (‘akl) and soul (nafs), forming the dynamic structure and the source for human’s positive and negative actions, should be educated in a certain measure and equilibrium, and who presented various concepts and terms in this direction. It seems that Muhāsibī refers to different concepts concerning the humans’ change and transformation, his education and training. In this respect, our study aims to deal with the concepts Muhāsibī used within education, religion and moral education in today’s terms and to reveal in which meanings he used these terms. It is also hoped that considering the concepts of education in the traditional and classical concept will make it easier to understand the current content of education, the changes and specialism it has experienced. The concepts that Muhāsibī dealt with on education, especially on decency (adab/ta’dīb), have a religious and moral theme in accordance with the general understanding of the period. Among the main concepts that Muhasibi includes are educating/teaching (ta‘līm/ta‘allum), instruction/teaching (dars/tadrīs), decency, purification (tathīr, ıslāh and tasfiya), and mucāhada. It seems that he doesn’t deal with the concepts such as tarbiyah, tahzīb, tazkiya and riyāzat at all or very little. Among them, Muhāsibī was especially interested in decency/adab, as it was handled in the context of Sufism, with a religious/moral view and mostly in the way of educating the soul. In addition, it is observed that other concepts are handled with a similar perspective. (shrink)

The words used in the languages generally have an original/basic meaning. However, these words gain new and special meanings over time apart from their basic meaning. These emerging meanings are not completely independent of the basic meaning. Because new and special meanings emerge on the axis of basic meaning. In the Qurʾān, naturally, many words are used in connotations other than their original meaning. Therefore, it is not possible to give a correct meaning to the verse without determining the meaning (...) of the words in the verses. In this study, it was investigated whether the conjunction ev in the verses was translated into Turkish correctly. For this purpose, firstly, the most accurate meanings of the conjunction ev in the verses discussed were tried to be determined from the vucūh and nezāir and tafsīr books, then these meanings were compared according to meāls and translation errors were pointed out. Accurate translations are emphasized; alternative translations are also presented when necessary. The conjunction ev in its basic meaning in Arabic indicates that the speaker is in doubt and hesitation in sentences expressing proposition and judgment In sentences such as orders and demands, it indicates that the addressee can choose between the options. However, this conjunction is sometimes used instead of conjunctions/prepositions such as and, even, to, until and except. In the vucūh and nezāir books, which are accepted as the Qurʾānic dictionary, it is agreed that the conjunction ev is used instead of and and even in the Qurʾān. In many tafsīrs much more meanings are given to the conjunction ev and it is stated that this conjunction is used instead of conjunctions such as until, to, except. In addition, it is stated in the some tafsīrs that conjunction ev adds various meanings to the expression such as elaboration, diversity, division and concealment. Where the conjunction ev is used in its basic meaning, translation errors were not made in the majority of the translations, except in very rare cases. Translation errors related to the conjunction ev mostly occurred when this conjunction was used out of its own meaning. Most of these errors are related to the words attributed to Almighty Allah by stating propositions and judgments. Because the conjunction ev used in these sentences indicates that the speaker is in doubt. However, this cannot be the case for Almighty Allah. Because Almighty Allah never doubts the matters He informs. Therefore, it is clear and certain that the conjunction ev is not used in the basic sense in such verses. It is determined that in the meāls we examined, this detail was generally not paid attention to. Although it is certain that the conjunction ev in these expressions attributed to Allah is not in the basic sense, it cannot always be clearly understood from the context in what sense it is used. Therefore, different opinions have been asserted in the sources on this issue. As a result, a scholar has taken the conjunction ev in any verse that comes in such a form to mean and, one to even, and another to except. The author of meāl usually prefers one of these meanings and tries to transfer it to the target language. However, it may not be possible to transfer every preferred meaning to meāl. For example, while it is possible to translate the meaning of and and even of the conjunction ev into Turkish, it doesn’t seem possible to transfer the meaning of ibhām/hide from the interlocutor. Therefore, a meāl writer who prefers the meaning of ibhām should translate this verse adhering to the words, and explain the meaning in the additional explanation section. Because in such a case, it is not possible to transfer the meaning to Turkish only through translation. Another reason why some verses in which the conjunction ev is used are translated incorrectly into Turkish is the attempt to convey the forms of expression particular to Arabic through literal translation. In such cases, the correct meaning should be determined first, and then the translation should be made without depending on the words. Because the purpose of translation is to convey the meaning, not the words. This study has confirmed that the author of the translation should have knowledge of the subtleties of the source and target language, and that he should make maximum use of the works written on vucūh and nezāir and the sources of tafsīr. However, it is also emphasized that every information contained in these works should not be accepted as essential without being subject to criticism. (shrink)

Al-Mu'jam Al-muḫtaṣ of Murtadā Al-Zabīdī (d. 1205/1791) in which a scholar recorded his teachers, the books that he obtained the right to narrate during his education life and the chain of transmission from his teachers to the author, is one of the important representatives of the mu'jam genres in 12th/18th century. It can be said that the mu'jam that Zabīdī wrote to record the important people in his life, goes beyond the standard mu'jam with its compilation style, sources, diversity of (...) biographers and anecdotes about the writing activity of the period. Based on Zabīdī's teachers, students and contemporaries, their origins, specialization and profession, the dates of their deaths, the dates of his encounters with them, the extent of his friendships, the dated rihle route, the lecture places and the books he taught, a panorama about the mu'jam will be drawn. The mu’jam, which includes 635 biographies, has a wide range of written and oral sources, especially ijazat and samā sources. Zabīdī's correspondence with scholars from different regions, taqrīz/appreciation written for his famous books and poems belonging to scholars of the period are among these sources. Numerous taqrīzs on his Tāj al-ʿArūs and Sharḥ Al-Iḥyā's point to their fame at that time, while Mu’jam, which has the appearance of an independent poetry anthology due to the poems that reach tens of pages, reveals his unknown poetic side. On the other hand, some couplets recorded in Persian and Turkish show his knowledge of these languages. Zabīdī is a versatile personality who lived in different geographies such as India, Yemen and Egypt and met many scholars there. Rihles in different regions of Yemen such as Zabid, Moravıa and Mocha, as well as inside Egypt, including Damietta, Raşıt, Fuwwah and Asyut, show that Zabīdī traveled frequently for the sake of knowledge. Egypt, where he went in 1167 (1753) with the advice of his teacher al-Aydarūs and spent thirty-eight years of his life, has an important place in his scientific adventure. Recording sufis, merchants and janitors as well as famous people from different fields such as poets, jurists and muhaddis in biographies reflects Zabīdī's extensive contact reaching various segments of society through the aforementioned rihles. While Zabīdī was obtaining knowledge through both these journeys and ijazat, he also gave ratification/ijazat to the students who came to him. While he prefers ijazat of al-musalsal bil awwaliyyah and Al-Awail Ṣaḥīḥ/al-Kutub al-Sittah for those who come to him for short periods of time on the occasion of pilgrimage, but on the other hand he gaves ijazat of Ṣaḥīḥ al-Bukhari, Shamail Tirmidhi, Sharḥ Al-Iḥyā and Al-Amali for his long-term students. Lessons, both open to the public in mosques and with more private groups at home, were held in informal rather than systematic/formal style like in the madrasah. The books that Zabīdī received the right to transmit through his rihles are listed below under the "textbooks" heading. When a book is mentioned in whichever biography, it can be implicitly considered the person has the elevated chain of transmission of the book. Similarly, it can be revealed in which region and by whom tranmits the short chain of a book. This reveals the unknown aspects of regional and temporal writing style. On the other hand, it is possible to find other traces of the background of writing and representation/taqrir through the mu'jam. For instance, a book was sometimes typed as a result of the students' compilation of lecture notes of their masters, sometimes when a person obtained a book he needed and he abbreviated important parts and copied a special copy for himself or a student could only get permission for giving lectures after he had written a book. The mu’jam includes besides of Zabīdī's books, the books written by the biographers in the form of "he has many books" or by mentioning the name directly. Even the recording of details such as the reason for writing, date and content information reveals the unknown aspects of the book writing style of the period. Ultimately, the importance of mu’jam, which was written as the result of a life spent with learning, although it is not well known in terms of genre; is to mention the biographical information collected from many different secondary sources, compiled as a result of long effort, such as history and tabaqat-tarajim about the scientific life of the author together with their evidences. Therefore, these kinds of books, that are mostly written by the author himself or his close student, in which the teacher constitutes its main element, is a primary source in the determination of the biographical information of the author, as well as the book and isnad, deserve to be examined separately because of their potential to shed light on the unknown aspects of the hadith history and literature of the later period. Genel olarak İslam düşüncesini özel olarak da fıkıh düşüncesini derinden etkileyen isimlerden biri de hiç şüphesiz Kâdî Abdülcebbâr’dır (öl. 415/1025). Hayatının çoğu hicrî 4./11. yüzyılda geçen ve Basra Mu’tezilesi’nin Cübbâî’lerden sonra en önemli temsilcisi olan Abdülcebbâr, hem kelam hem de fıkıh usûlü alanındaki eserleriyle sadece Mu’tezilî çevrelerde değil Sünnî muhitlerde de çığır açıcı bir âlim olarak görülmüştür. Birçok Sünnî usûlcünün ortak kanaatine göre İmam Şâfiî’den sonra fıkıh usulü alanındaki en önemli isimlerden biri Abdülcebbâr’dır. Teoloji ve metodoloji alanlarında bu denli etkili (...) olan Kâdî Abdülcebbâr’ın amelî hayatını hangi sistematik çerçevede sürdürdüğü ve öğrenciliği sırasında benimsemiş olduğu Şâfiî mezhebine bağlılığını devam ettirip ettirmediği merak konusu olmuştur. İlgili literatürde Kâdî Abdülcebbâr’ın hayatı boyunca Şâfiî mezhebini benimsediği iddiası çokça dillendirilmiştir. Öyle ki Şâfiî fakihlerin tanıtıldığı tabakât eserlerinde Abdülcebbâr’a bir Şâfiî olarak yer verilmiştir. Günümüze kadar devam eden bu anlayış akademik çalışmalarda da devam eden bir kabul halini almıştır. Acaba gerçek böyle midir? Bu sorunun peşine düşen elinizdeki araştırma, şu adımlarla konuyu incelemiştir: Önce Kâdî Abdülcebbâr’ın fıkıhta takip ettiği yol ile ilgili olarak literatürde zikredilen iddialar sergilenmiş, ardından Abdülcebbâr’ın Mu‘tezile usûlündeki konumu ortaya konmuştur. Mu’tezilî bir âlimin benimsediği iddia edilen mezhebin kurucu imamının yani Şâfiî’nin (öl. 204/820) Mu‘tezile’ye olan mesafesi ve hatta onunla mücadelesine değinildikten sonra Kâdî Abdülcebbâr’ın İmam Şâfiî’nin meşhur usûl görüşlerine muhalif tavırları tespit edilmiştir. Abdülcebbâr’ın usûl görüşlerini İmam Şâfiî’nin usûl görüşleriyle mukayese ederek ilerleyen işbu araştırma, onun amelî sahada Şâfiî mezhebini benimsemiş olduğu iddiasının çok isabetli olmadığı sonucuna ulaşmıştır. Mukayeseyi, Şâfiî usûl düşüncesinin en ayırt edici 6 (altı) meselesi üzerinden yürüten araştırma Abdülcebbâr’ın İmam Şâfiî’ye ve Şâfiî usûlcülere açıkça muhalefet ettiğini göstermektedir. İslam hukuk metodolojisinin en önemli tartışma konuları arasında yer alan bu altı mesele şunlardır: Kur’ân ve Sünnet’in birbirilerini nesh edip edemeyeceği, Peygamber’den nakledilen söz ve fiillerin kabulünün ön şartı olarak bunların Kur’an’a arzı yani delil olabilmesi için Kur’an’ın ilgili düzenlemesiyle uyumlu olup olmadığının tespiti hususu, kıyas sonucu ulaşılan hükmü bir gerekçeye dayanarak terk edip başka bir hüküm koymak demek olan istihsân, çözüm bekleyen yeni meselenin iki veya daha fazla asla/makîsün aleyhe birden benzemesi halinde birçok açıdan en çok benzediği düşünülen aslı dikkate alarak söz konusu yeni meseleye bu aslın hükmünü vermek demek olan şebeh kıyası, mefhûmu’l-muhâlefenin yani bir sözün ters anlamının o sözdeki meselenin tam tersi olup hükmü belirtilmeyen meseleye aktarımı anlamına gelen karşıt kavram kanıtının sahih bir istidlal sayılıp sayılmaması ve emir kipinin hangi anlama geleceği konusu. This article proposes a theological emphasis to the definition of προσλαμβάνω in Romans 14–15. Previous accounts have emphasised the domestic and social implication of Paul's imperative—‘welcome one another’ (Rom. 15:7a). The result has been that what Paul might have meant by God's and Christ's ‘welcome’ (Rom. 14:3 and 15:7b) has been governed by the ethical imperative. In order to investigate the ‘welcome’ of God and Christ, this article proposes a context of three important Septuagintal antecedents as yet unconsidered: 1 Samuel (...) 12, Psalm 18, and Psalm 65: In this context, God's and Christ's ‘welcome’ in Rom. 14–15 incorporates notions of justification, election, salvation, and unified worship. A theological reading of προσλαμβάνω, using these intertextual resources, therefore provides a stronger position from which to understand Paul's imperative—‘welcome one another’. (shrink)

Both the concept of a Darwinian tree of life (TOL) and the possibility of its accurate reconstruction have been much criticized. Criticisms mostly revolve around the extensive occurrence of lateral gene transfer (LGT), instances of uptake of complete organisms to become organelles (with the associated subsequent gene transfer to the nucleus), as well as the implications of more subtle aspects of the biological species concept. Here we argue that none of these criticisms are sufficient to abandon the valuable TOL concept (...) and the biological realities it captures. Especially important is the need to conceptually distinguish between organismal trees and gene trees, which necessitates incorporating insights of widely occurring LGT into modern evolutionary theory. We demonstrate that all criticisms, while based on important new findings, do not invalidate the TOL. After considering the implications of these new insights, we find that the contours of evolution are best represented by a TOL. (shrink)

Prof. Dr. Fuat Sezgin Prof. Dr. Fuat Sezgin anısına ithaf ettiğimiz Felsefe ve Din Bilimleri Özel Sayımıza hoşgeldiniz. Prof. Dr. Fuat Sezgin, 24 Ekim 1924 tarihinde Bitlis’te dünyaya gelen Fuat Sezgin, il-kokulu Doğubayazıt’ta, ortaokul ve liseyi ise Erzurum’da bitirdikten sonra 1943 yılında İstanbul’a geldi. İstanbul Üniversitesi şarkiyat (Doğu bilimi) Araştırmaları (...) Enstitüsü’nde ünlü Alman şarkiyatçı Prof. Dr. Hellmut Ritter’in (1892-1971) öğrencisi olan Sezgin, Ritter’in tavsiyesi üzerine İslâm bilimlerine yöneldi. 1951’de İstanbul Üniversitesi Edebiyat Fakülte-si’den mezun olduktan sonra Arap Dili ve Edebiyatı alanında “Buhârî’nin Kaynakları Hakkın-da Araştırmalar” başlıklı teziyle doktorasını tamamladı. Bu çalışmasıyla, hadis kaynağı olarak İslâm kültüründe önemli bir yere sahip olan Buhârî’nin sözlü kaynaklar yerine yazılı kaynaklara dayandığı tezini ortaya attı. Doçent unvanını 1954 yılında alan Sezgin, 1960 askeri darbesinin ardından üniversi-telerden uzaklaştırılan 147 akademisyen arasında kendi adının da bulunması üzerine 1961’de Türkiye’den ayrıldı ve çalışmalarına Goethe Üniversitesi’nde (Frankfurt) devam etti. Câbir bin Hayyân hakkında hazırladığı ikinci tezini 1965’te Goethe Üniversitesi Doğa Bilimleri tarihi Enstitüsü’ne sunan ve bir yıl sonra profesörlüğe yükseltilen Sezgin, aynı yıl kendisi gibi şarkiyatçı olan Ursula Sezgin ile Evlendi. Alanında şimdiye kadar yazılan en kapsamlı eser kabul edilen Geshichte des arabisc-hen Schrifttums (Arapça Yazma Eserler Literatürü Tarihi) başlıklı kapsamlı eserinin ilk cildini 1967’de yayımlayan Sezgin, 1978’de Kral Faysal İslâmi İlimler Ödülü’ne lâyık görüldü. Bu ödül nedeniyle kendisine takdim edilen maddi desteği değerlendirerek 1982’de Goethe Üniversitesi Arap-İslâm Bilimleri Tarihi Enstitrüsü’nü, ertesi yıl ise bu enstitü bünyesinde, tarih boyunca Müslüman bilim insanlarının icat ettiği 800’den fazla bilimsel alet ve düzene-ğinin modellerinin sergilendiği İslam Bilim ve teknoloji Müzesi’ni kurdu. Bu müzenin bir benzerini 2008 yılında istanbul’da kuran Sezgin, 2010 yılında Prof. Dr. Fuat Sezgin İslam Bilim Tarihi Araştırmaları Vakfı’nın kuruluşuna öncülük etti. Kahire Arap Dili Akademisi, Şam Arap Dili Akademisi, Fas Rabat Kraliyet Akademisi, Bağdat Arap Dili Akademisi, Türkiye Bilimler Akademisi şeref üyeliği de dâhil olmak üzere çok sayıda ödül ve nişana layık görülen Sezgin’e; Erciyes Üniversitesi, Atatürk Üniversitesi, Süleyman Demirel Üniversitesi ve İstanbul Üniversitesi tarafından fahri doktora unvanları verildi. Frankfurt am Main Goethe Plaketi, Almanya Üstün Hizmet Madalyası, İran İslâmi Bilimler Kitap Ödülü ve Cumhurbaşkanlığı Kültür ve Sanat Büyük Ödülü ile taltif edildi. Prof. Sezgin’in öncülüğünde kurulan İstanbul İslâm Bilim ve teknoloji tarihi Müzesi, Kültür ve Turizm bakanlığı 2016 özel Ödülü’ne lâyık görüldü. Arapça, Süryanice, İbranice, Latince ve Almanca başta olmak üzere 27 dil bilen Prof. Dr. Fuat Sezgin, 30 Haziran 2018’de İstanbul’da vefat etti ve Gülhane Parkı’ndaki İstanbul İslâm Bilim ve teknoloji tarihi Müzesi’nin bahçesine defnedildi. Vefatının ardından, 2018/6 sayılı Cumhurbaşkanlığı genelgesi ile 2019 yılı “Prof. Dr. Fuat Sezgin Yılı” olarak ilân edildi. Cumhurbaşkanlığı genelgesinde "İslam kültür ve medeniyetinin daha iyi anlaşılmasını sağlamak ve onu yeni nesillere en doğru şekilde aktarmak amacıyla yapılacak söz konusu çalışmalara ilgili tüm kamu kurum ve kuruluşlarınca her türlü destek ve katkının sağlanması hususunda gereğini rica ederim." İfadelerine yer verilerek Fuat Sezgin’in ülke sathında anlatılması ve düşüncelerinin anlaşılması için çeşitli faaliyetlerin yürütülmesi istenmişti. Koordinasyon Merkezi olarak da Kırıkkale Üniversitesi seçildi Dünyanın önde gelen bilim tarihçilerinden olan, İslam Bilim Tarihi alanındaki çalışmaları bulunan Prof. Dr. Fuat Sezgin’i gelecek nesillere tanıtmak, fikirlerini anlatmak amacıyla Sivas Cumhuriyet Üniversitesi tarafından da birçok faaliyet yapıldı. Dünyanın önde gelen bilim tarihçilerinden Prof. Dr. Fuat Sezgin’e, İslam Bilim Tarihi alanındaki çalışmalarından dolayı Üniversitemiz tarafından “Fahri Bilim Doktoru” unvanı verildi. Prof. Dr. Sezgin’e fahri bilim doktoru unvanı verilmesi dolayısıyla Üniversitemiz Kül-tür Merkezi’nde düzenlenen tören İstiklal Marşımızın okunması ve saygı duruşuyla başladı. Programa Rektörümüz Prof. Dr. Alim Yıldız, Sivas Belediye Başkan Yardımcısı Ah-met Özaydın, Fatih Sultan Mehmet Üniversitesi Rektörü Prof. Dr. Musa Uzun, öğretim elemanları ve öğrenciler katıldı. Rektörümüz Prof. Dr. Alim Yıldız yaptığı açış konuşmasında, "İnsanlara İslam bilimlerinin gerçeğini tanıtmak, benlik duygularını olumsuz etkileyen yanlış yargılardan onları kurtarmak ve ferdin ehemmiyetine olan inancı kazandırmak amacıyla İslam Bilimi Tarihi araştırmalarına adanmış bir ömürdür Prof. Dr. Fuat Sezgin Hocamız. Öyle büyük bir otoritedir ki onu anmadan, onun hazırladığı eserlere bakmadan, bilim tarihiyle, İslam tarihiyle ilgili ortaya bir şeyler sunabilmek çok zordur. Bilim tarihinin en çalışkan, en birikimli bilim insanlarından biridir. Daha sonra Sezgin katılımcılara ‘Arap İslam Tarihinden Bazı İzlenimler’ konulu ders verdi. Prof. Dr. Fuat Sezgin, “İnsanların bilgi tarihi ile ilgili verileri yazılı olarak kaydetme gayreti, politik tarihe olana nispetle tesadüflere ve keyfi değerlendirmelere göre çok geri zamanlarda oldu. İslam bilim tarihi yüksek ve kaliteli görüşleri yansıtır. Bunları burada sunamayacağım. Birçoğunu Arap-İslam tarihi adlı kitabımın bugüne kadar çıkmış olan 17. cildinde kaydetmeye çalıştım. Onu İstanbul’da Gülhane Parkı’nda İslam Tarihi Araştırmaları Vakfı yayınları arasında bulabilirsiniz.” dedi. Prof. Dr. Sezgin “Bilimler tarihinin verilerini değerlendirmekte, yaşanılan zamanın etüt şartını gözden kaçırılmasının esas olması gerektiğini anladım ve henüz kitabımı yazma-ya başlamadan rastladığım Fransız Coğrafya tarihçisi Joseph Toussaint Renaud (1795-1867)’un şu sözleri beni çok etkilemişti. “Tesadüf teknik ve sanatın ilerlemesinde çok büyük bir rol oynamaz. İnsanlar buluşlarında devamlı bir şekilde birden bir sıçrayışla değil, adım adım hareket eder. Her zaman aynı hızda değil, fakat devamlı olarak insan icat etmez. Olanı ilerletir.” ifadelerine yer verdi. Konuşmasının sonunda Prof. Dr. Sezgin, “Benim 65 yıldır yaymaya çalıştığım Arap İslam bilimleri tarihi hemen hemen her gün beni hayata bağladı. İslam dünyasında büyük bir hızla ilerleyen bilimler MS. 8. yüzyıldan itibaren Fransa ve İngiltere’ye diğer taraftan 10 ve 11. yüzyıldan itibaren Sicilya’ya ve İtalya’ya 9. yüzyıldan itibaren Bizans’a ulaştılar. Avrupa-lılar teknik bilimleri diğer bilimlere nazaran daha kolay anlıyor ve alabiliyorlardı. Bu anlam-da onlar 16. yüzyılda bazı yönlerde Müslümanlara ulaşmaya hatta onları geçmeye başladılar.” ifadelerini kullandı. Programın sonunda Rektörümüz ve Fatih Sultan Mehmet Üniversitesi Rektörü Prof. Dr. Musa Duman, Prof. Dr. Fuat Sezgin’e tezhipli bir tablo hediye ettiler. 2019 Prof. Dr. Fuat Sezgin Yılı kapsamında Sivas Cumhuriyet Üniversitesi Merkezî Kütüphanesi’ne Prof. Dr. Fuat Sezgin’in ismi verildi. Ayrıca Üniversitemiz Rektörlüğü tarafından düzenlenen 5’inci Hazan Şiir Dinletisi Sezgin anısına ithaf edilmiştir. 2019 yılının Haziran ayı içerisinde ise Üniversitemiz Rektörlüğü öncülüğünde ve İlahiyat Fakültesi Dekanlığınca ile Sivas Merkez Ulu Cami’de merhum Prof. Dr. Sezgin için Kur’an-ı Kerim tilaveti ve Mevlid-i Şerif programı gerçekleştirilmiştir. Son olarak üniversitemiz rektörlüğü tarafından desteklenen ve Sivas Cumhuriyet Üniversitesi İlahiyat Fakültesi tarafından yayımlanan Cumhuriyet İlahiyat Dergisi’nin 23. Cilt 3. This chapter argues for the History of England’s importance in Hume’s overall achievement. The chapter describes the History’s genesis, reception, methods, and aims. In the role of historian, Hume shared with the ancients the assumption that history is an elevated genre functioning as the “Mistress of Wisdom.” Yet this long work is more notable for historiographical innovation. Like William Robertson and Edward Gibbon, Hume wrote conjectural or philosophical history. Like Machiavelli, Voltaire, and Montesquieu, Hume wrote civil or cultural history, including (...) detailed information on political events, law, commerce, and manners. In a larger sense, the History demonstrates a great philosopher leaving his study to deal with that practical, sometimes intractable world outside the study. A priori reasoning is tested against that a posteriori reality provided by historical evidence. Thus, in writing the History, Hume became an empiricist in an almost literal sense. (shrink)

The intra-school controversies in Hanafī school are remarkable. These controversies pose a risk for legal safety and stability and creates difficulties for muqallīd Hanafī judges and muftīs. In the historical process, different types of literature such as mukhtaṣar and fatwa (legal opinion) books, and applications such as aṣṣaḥ-ı aqvāl and maʻrūdhāt, emerged to solve this problem. One of the last example of these applications is the codification movement. The subject of this study is the relationship between the Majalla al-Aḥkām al-ʿAdliyyah, (...) which is the first product of codification based on fiqh (Islamic jurisprudence), and the intra-school preference. In order to describe this relationship, it is briefly emphasized that one of the aims of codification of Majalla is to satisfy the need for intra-school preference. The function and content of Majallaʼs necessary reasons, (asbāb al-mūjiba) was analyzed in terms of intra-school preference. The interventions on the preferences of the Majalla Commission are also emphasized. The Majalla is a text of the intra-school preference. The analysis of its content in relation to intra-school preference is very important. Therefore, in order to reveal what kind of method is used in intra-school preferences and to determine different aspects of intra-school preference in the Majalla, the chapter about ‘sale’ (Kitāb al-Buyūʿ) of the Majalla are examined.Summary: The intra-school controversies in Hanafī School, which is quite important in terms of freedom of ijtihād (independent legal judgment) and legal wealth, possible to threaten legal safety and stability. These controversies also make difficult for judges to reach a judgment or fatwa in controversial affairs. For this reason, determination of the rājiḥ (preferred opinion) in controversial issues in the school, is a need that must be eliminated.The intra-school preference can be described as "to determine the superior, preponderant of different opinion or narrations about a specific issue in the school". In the historical process different types of literature such as mukhtaṣar and fatwa books, and different applications such as asaḥḥ-ı aqvāl and maʻrūzāt, emerged to meet this need. One of the applications aimed to meet this need is the codifications in the last period of the Ottoman State.The relationship between the Majalla al-Ahkam al-Adliyyah, which is the first example of codification based on fiqh (Islamic jurisprudence), and the intra-school preference; and in this context, while preparing the Majalla how a method was followed in the intra-school preference; at what rate be obeyed the rājiḥ (preferred) opinion; articles contrary to the rājiḥ (preferred) opinion in Majalla and their reasons; whether legal arrangements have been made in all controversial issues; at what rate be met the need of determination of rājiḥ (preferred) opinion are the issues that need to be examined.One of the main reasons for the need for a law text such as Majalla al-Ahkam al-Adliyyah is the multitude of the intra-school controversies in Hanafī School. Therefore, the goal of Majalla is to prepare a code that contains rājiḥ opinion.When Majallaʼs necessary reasons, i.e. asbāb al-mūjiba, are examined in terms of the intra-school preference, it is seen that there are two basic functions of necessary reasons. The first of them is, emphasizing that the code is prepared substantially in accordance with the râjih opinion in the school. In fact, that this issue in the asbāb al-mūjiba of the first ten books of Majalla is expressly stated. The other function of the asbāb al-mūjiba is to justify that why rājiḥ opinion are not be confirmed in some article. In the necessary reasons it is stated that twelve articles are prepared in the direction of unrâcih (unpreferable) opinion. Considering that Majalla is formed of 1851 article, it will be better understood that how the rājiḥ opinions are effective in Majalla's content. Essentially, the conditions of the period also make it necessary. The preference of the non-preferred opinion of Züfer (d. 158/775) in 692nd article of Kitāb al-Ḥavala, caused the reaction of some circles mainly Şeyhülislam Hasan Fehmi Efendi (d.1298/1881) and for this reason Ahmet Cevdet Pasa (d.1895) was dismissed from the ministry of Divan al-Ahkâm al-Adliyyah and the chairman of the Majalla Commission.When the asbāb al-mūjibas of contrary articles to rājiḥ opinions are examined, it is seen that maṣlaḥa and customs are determinative in these preferences. It is also seen that the preferences of some jurists are also mentioned as a reason of preference. The most widespread preference’s reason in Hanafī sources is in congruity with the texts. On the contrary, it is noteworthy that, besides the interdiction of extravagant (safih), it is not operated as a preference’s reason in Majalla.Some preferences of the Majalla Commission were intervened by other institutions. The chapters prepared by the commission were examined both by Majlis-i Wukalā and Mashihat, and these chapters were subject to some revisions at this time. Here, two articles prepared on the basis of the non-preferred opinion were intervened by Majlis-i Wukalā. The first of these is 216th article that written in the direction of opinion of Mashāyikh Balkh, which argues that it is permissible to sell separately ḥaqq al-murūr (the right of passage) and ḥaqq al-shirb (water right), the second is the 611th article which regulates the liability to damage of ajīr al-mushtarak (joint salaried employee).When the content of Kitāb al-Buyū, the first and the most voluminous book of Majalla, is examined in terms of the intra-school preference, it is seen that the rājiḥ opinions in the school are generally taken as basis. It is stated that in the asbāb al-mūjiba of the Kitāb al-Buyūʿ the four issues are prepared basing on the non-preferred opinion and these preferences are justified with custom and maṣlaḥa. However, the contrary articles to the rājiḥ opinion in the Kitāb al-Buyūʿ are not limited to these. According to our research, in addition to these, three articles were prepared with the preference of non-preferred opinion. These are the 118th article regarding that the bayʻ bi-l-wafā is permissible in chattels, 165th article on the definition of al-ghabn al-faḥiş (lesion), and the 309th article concerning the provision of the khiyār al-sharṭ (right of cancellation). These three articles show that the regulations contrary to the rājiḥ opinion in Majalla are not just those explained in the asbāb al-mūjiba and this situation is contrary to the method that is followed when preparing the Majalla.In some controversial issues in the Hanafi School, authorized jurists to preference (asḥāb al-tarjīh) disagreed over which opinion is rājiḥ. It wasn’t explained that how a method would be followed in Majalla when the legal arrangements were made in these matters. When these issues are examined, it can be said that the preferences of the majority, the providing of convenience and the preference by some jurists are effective.Preferences in Majalla have not been occurred only among the sharʻī (related to Islamic Law) provisions. In addition, the definitions and the inscription in the definitions are also the subject of preference. In this context, the preferences related to the definition of the sales contract, the suspended contract (al-ʻaqd al-maqqūf) and the al-ghabn al-faḥiş in Kitāb al-Buyūʿ can be mentioned as an example.Some controversial issues in the Hanafi School are not regulated in Majalla. When considering the multiplicity of controversial issues and therefore the difficulty of making legal arrangements to cover all of them, this situation is natural. Moreover, some of these issues may not have been regulated in Majalla because they are not frequent and necessary. However, it is not possible to explain all the controversial issues that have not been regulated for these reasons. Because some of the controversial issues that have not been legislated are basic, relatively important issues and they are included in the mukhtaṣars. This indicates that when preparing the Majalla, instead of making preference on some controversial issues, the method of non-regulation of these matters is adopted. It can be said that this method is applied as a way of creating law text which is clear of controversy. Thus, the determining of the rājiḥ opinion in these matters has been left to the judges. This situation is not suitable to meet the need of determining the rājiḥ opinion, which is the goal of Majalla. But it is the result of the difficulty of making a law that encompasses all legal issues. (shrink)

Scientists recognize the necessity of imagination for solving tough problems. But how does the cognitive faculty responsible for daydreaming help in solving scientific problems? Philosophers claim that imagination is informative only when it is constrained to be maximally realistic. However, using a case study from space science, we show that scientists use imagination intentionally to break reality-oriented constraints. To do this well, they first target low-confidence constraints, and then higher-confidence constraints, until a plausible solution is found. This paper exemplifies a (...) new approach to epistemology of imagination that focuses on sets of imaginings (rather than individual imaginings), and responsible (rather than reliable) imaginings. In this paper we examine C. I. Lewis's view on the roleof coherence – what he calls ''congruence'' – in thejustification of beliefs based on memory ortestimony. Lewis has two main theses on the subject. His negativethesis states that coherence of independent items ofevidence has no impact on the probability of a conclusionunless each item has some credibility of its own. Thepositive thesis says, roughly speaking, that coherenceof independently obtained items of evidence – such asconverging memories or testimonies – raises (...) the probabilityof a conclusion to the extent sufficient for epistemicjustification, or, to use Lewis's expression, ''rationaland practical reliance''.It turns out that, while thenegative thesis is essentially correct, astrong positive connection between congruence andprobability – a connection of the kind Lewis ultimatelyneeds in his validation of memory – is contingent on thePrinciple of Indifference. In the final section we assess therepercussions of the latter fact for Lewis's theory in particularand for coherence justification in general. (shrink)

This paper disputes the widely held view that one cannot establish the reliability of a belief-forming process with the use of belief's that are obtained by that very process since such self-dependent justification is circular. Harold Brown ([1993]) argued in this journal that some cases of self-dependent justification are legitimate despite their circularity. I argue instead that under appropriate construal many cases of self-dependent justification are not truly circular but are instances of ordinary Bayesian confirmation, and hence they can raise (...) the probability of the hypothesis as legitimately as any such confirmation does. I shall argue in particular that despite its dependence on perception we can use naturalized epistemology to confirm the reliability of a perceptual process without circularity. (shrink)

Peirce earned his keep making measurements, mainly of gravity but also astronomical, and he made several contributions to the science of measurement. It has been said that his experience measuring had philosophical consequences: his adoption of fallibilism, his argument against necessitarianism, and his conception of inquiry as converging on the truth have all been mentioned. But not much attention has been paid to the curious episode of his making “the study of great men” part of a course in logic: students (...) were asked to rank a long list of men by order of greatness. That was at Johns Hopkins in 1883. I shall argue that that study, together with his reflections on pre-instrumental estimates of stars’ brightness, bears directly on the method of phaneroscopy formulated nearly two decades later. In each case, the problem is to show how objectivity is possible under conditions in which it must seem that objectivity is impossible. (shrink)
